26 GENERAL PROVISIONS When one of these holidays falls on a Sunday, it is officially observed on the following Monday. When a holiday falls on a Saturday, it is officially observed on the preceding Friday. When Christmas Day occurs on a Saturday, the preceding Thursday and Friday shall be observed as the holidays. When Christmas Day occurs on Sunday, the two(2) days to be observed as the holidays will be specified by the City of Lamar. When a holiday falls during an employee's Vacation Leave the day shall be counted as a holiday and not as a day of Leave. An employee who terminates employment or commences an unpaid leave of absence on the last scheduled workday preceding a holiday will not receive Holiday Pay. ELIGIBILITY All Regular, Full-time employees, including those still serving the Introductory Period are eligible to receive Holiday Pay as provided in this Policy Manual. Temporary Employees are not eligible for Holiday Pay In order to receive pay for a holiday an employee must have worked on their last regularly scheduled day of work preceding the holiday and their next regularly scheduled day of work following the holiday. This applies to only employees who are considered non-exempt (hourly). Paid leave scheduled in accordance with the City's Leave Policy will satisfy this requirement. HOLIDAY PAY All regular, nonexempt, full-time employees in good standing will receive Holiday Pay at their regular straight time hourly rate of pay for the number of hours normally scheduled to be worked on that day, provided they meet the following conditions: • Work a full shift on the employee’s last scheduled work shift prior to the paid holiday, unless paid leave is scheduled in accordance with the City's Leave Policy. • Work a full shift on the employee’s first scheduled work shift following the holiday, unless paid leave is scheduled in accordance with the City's Leave Policy. • Eligible employees whose regular work schedule requires them to work on one of the Holidays observed by the City shall receive Holiday pay for that day in addition to for hours actually worked on that day. • Employees who are "called out" or specially requested to work on a Holiday because of project deadlines or other operational concerns, shall receive the holiday pay and shall be compensated at one-and-one-half times (1½) their regular hourly rate for the hours actually worked on that day. • Should the employee be unable to work either of these two days because of illness, proof of illness will be required to qualify for the paid holiday. • Employees will not be entitled to holiday pay if they are on an unpaid leave of absence when the holiday occurs. An employee who is scheduled to work and actually works on either the Holiday as observed by the City, or the actual Holiday will be compensated in this manner on one of these days, but not both. The affected employee may choose which day to observe as the holiday. PERSONAL DAYS Eligible employees shall be given annually two days of paid leave time as Personal Days. These Personal Days may be used at a time of the employee's choosing, subject to the business needs of the City and the approval of the supervisor. All Personal Days credit unused by December 31 of each calendar year shall be forfeited.
