21 • Hourly paid police officers, fire fighters, Emergency Communicators, and EMTs will be paid a Premium Pay of one-and-one-halftimes their regular hourly rate of pay for all hours worked in excess of the base hours defined above. • Premium pay for overtime will not be pyramided. An hour compensated at the overtime premium rate will not be counted again for the payment of premium pay for any other reason. City provided paid time off including, but not limited to Annual Leave, Sick Leave, Holidays, Floating Holiday, Injury Leave and Compensatory Time-Off is not considered time worked for the purpose of computing overtime benefits. Section 9. Compensatory Time-Off In most cases, it is the policy of the City to grant Compensatory Time Off (Comp Time) to employees who work overtime in-lieu of pay for overtime. When the Department Director deems it necessary to work overtime, the employee must elect to receive Comp Time or receive overtime pay. If the employee chooses to be paid for the overtime, prior written approval must be received from the City Treasurer. • Comp Time will be earned at the rate of one and one-half hours for each hour of overtime worked. • Comp Time earned will be reported on the employee's Time Sheet submitted for the week. • Comp Time may be used in the same manner as Annual Leave (see Annual Leave Section). • Hourly paid employees may carry-over a maximum balance of 40 hours of Comp Time at the end of the calendar year. • Unused, accumulated Comp Time-Off will be paid out to the employee when his or her employment terminates. • Comp Time cannot be transferred to another employee. Section 10. Shift Differential Pay For purposes of this provision, the following definitions will apply: A. "Swing shift" means any regularly-scheduled workday where the employee is assigned to work a majority of his or her duty assignment between the hours of 3:00 p.m. and 11:00 p.m. B. "Graveyard shift" means any regularly-scheduled workday where the employee is assigned to work a majority of his or her duty assignment between the hours of 11:00 pm and 7:00 am. General Provision. Shift differential premiums shall be calculated with respect to each workday and, when paid, shall be in addition to all other compensation earned by the employee and subject to all withholding requirements applicable to the employee's compensation. The dollar amount of each shift differential premium payable under this provision to any eligible employee shall be determined with respect to a shift differential premium rate of either $0.50 per hour worked for the Swing shift or $1.00 per hour worked for the Graveyard shift. Employees working 24-hour shifts are not eligible for Shift Differential premium pay. As to each workday during which an employee earns a shift differential premium, the dollar amount of the premium shall be calculated by multiplying the actual number of hours worked by such
